1. Scope and Contracting Party

These General Terms and Conditions (T&Cs) apply to all contracts between Barmiestqira GmbH (Share Capital €10,000, Managing Director Christoph Gruber), Landstraße 142, 4020 Linz, and its clients. Barmiestqira GmbH provides professional services in the field of laser engraving and laser cutting.

2. Orders and Quotations

Submitting an inquiry via the contact form or email does not constitute a binding offer, but rather a request for a quotation. A contract is only formed upon the written confirmation of the order by us. The basis of the work is the vector layout provided by the client or agreed upon jointly.

3. Pricing and Payment Terms

All stated prices include the statutory VAT of 20%. For every order, a deposit of 50% of the total amount is due before production begins. The minimum order value is €25. Express orders requiring prioritization are subject to a rush fee of 30% on the final price.

For B2B clients (companies), a payment term of 14 days after invoicing applies. All payments are made in Euros.

4. Execution and Modifications

A final coordination of the layout takes place before the start of laser processing. Changes to the design after approval by the client may incur additional costs. We strive for precise implementation; however, please note that natural materials (wood, leather) may exhibit slight variations in color and structure.

5. Ownership and Usage Rights

By placing an order, the client confirms that they hold all necessary rights to the submitted logos and graphics. Barmiestqira GmbH declines any liability for copyright infringements of third parties. The physical products become the property of the client upon full payment. Vector files created by us will be provided after full payment has been received.

6. Right of Withdrawal and Cancellation

In accordance with the Fern- und Auswärtsgeschäfte-Gesetz (FAGG) and the Konsumentenschutzgesetz (KSchG), the right of withdrawal expires for goods that have been manufactured to customer specifications or are clearly tailored to personal needs. Since our laser works are individually customized, cancellation after the start of production is not possible; in such cases, the deposit paid will not be refunded.

7. Liability and Warranty

Barmiestqira GmbH is only liable for damages resulting from intentional or grossly negligent breach of duty. The warranty is governed by the statutory provisions of the Republic of Austria. Complaints must be submitted in writing within 7 days after receipt of the goods.

8. Final Provisions and Jurisdiction

Austrian law applies exclusively. The place of performance and jurisdiction for all disputes arising from this contractual relationship is Linz. Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
